Terms of Service

1. Agreement

These terms govern your use of ErgonHQ (the “Service”), operated by PixelForge Labs LLC (“we”, “us”). By creating an account or using the Service, you agree to them. If you are agreeing on behalf of a business, you represent that you have the authority to bind that business.

2. What the Service is

ErgonHQ provides AI workers that perform business tasks on your behalf — answering calls and messages, booking appointments, following up on estimates and invoices, requesting reviews, publishing social posts, and managing advertising you approve. Each worker acts under your direction and within limits you configure. Every caller and correspondent is told they are dealing with an automated assistant.

3. Your account and your responsibilities

You are responsible for the accuracy of the information you provide, for the security of your account credentials, and for the instructions you give your workers. You must have the legal right and any necessary consent to contact the people you direct us to contact, and your use must comply with applicable law — including the TCPA, CAN-SPAM, and state marketing and recording laws. You may not use the Service for unlawful, deceptive, harassing, or discriminatory purposes, to send content you have no right to send, or to impersonate anyone.

4. Connected services and integrations

The Service can connect to third-party tools you already use — including Jobber, Google (Calendar, Search Console, Ads), Meta (Facebook, Instagram), LinkedIn, Stripe, and telephony and email providers. When you authorize a connection:

• You grant us permission to access, and where you direct it write to, the data in that account on your behalf. We request only the access the features you enable require.
• We use that data solely to operate the Service for you. We do not sell it, share it for anyone else’s marketing, or use it to train generalized AI models.
• You may disconnect any integration at any time from your dashboard, or revoke access from within the third-party service. Disconnecting stops further access immediately.
• Your use of each third-party service remains governed by that provider’s own terms, and we are not responsible for their availability, accuracy, or changes to their APIs.

ErgonHQ is an independent product. We are not affiliated with, endorsed by, or sponsored by Jobber, Google, Meta, LinkedIn, or any other provider named here; their names and marks belong to their respective owners and are used only to identify the integration.

5. Automated decisions and human oversight

AI workers can make mistakes. You set the thresholds at which a worker must stop and escalate to a person, and actions with financial or reputational consequence — spending on advertising, publishing content, sending outreach — are gated on your approval by design. You remain responsible for reviewing your workers’ output. The Service is not legal, financial, medical, or tax advice.

6. Fees

Workers are priced individually per month, like a salary, and billed through Stripe. New workers start with a 14-day free trial. Subscriptions renew monthly until cancelled; you can cancel any worker at any time and the cancellation takes effect at the end of the current billing period. Fees already paid are non-refundable except where required by law. Advertising budgets you approve are paid directly to the ad platform and are not part of your ErgonHQ fees. We may change prices with at least 30 days’ notice.

7. Your data

Your business data and your customers’ data remain yours. We process it to operate the Service, and we handle it as described in our Privacy Policy. You can export or request deletion of your data at any time by emailing us.

8. Availability and termination

We aim to keep the Service running continuously but do not guarantee uninterrupted availability. You may stop using the Service at any time. We may suspend or terminate an account that violates these terms, creates legal or security risk, or is materially past due, with notice where practical.

9. Disclaimers and limitation of liability

The Service is provided “as is” without warranties of any kind to the fullest extent permitted by law. We do not warrant any particular business result. To the maximum extent permitted by law, our total liability arising out of or relating to the Service is limited to the amounts you paid us in the twelve months before the claim, and we are not liable for indirect, incidental, or consequential damages.

10. Changes

We may update these terms; material changes will be posted here with a new date, and continued use after that constitutes acceptance.

11. Governing law and contact

These terms are governed by the laws of the State of Minnesota, United States, without regard to conflict-of-law rules. Questions: support@pixelforgelabs.co.

Text messaging program terms

These additional terms apply to the PixelForge Labs / ErgonHQ text messaging program.

Program description

When you opt in to the text messaging program, you agree to receive appointment and account text messages at the number you provide — including appointment and booking confirmations, appointment reminders, replies to your inquiries, and account or service-support responses. We do not send messages on behalf of any other business.

Message frequency

Message frequency varies based on your interactions with us.

Cost

Message and data rates may apply, per your mobile carrier plan. We do not charge for the messages themselves.

Opt-in

You opt in by entering your mobile number and checking the consent box on our text messaging program page. Consent is not a condition of any purchase.

Opt-out

You can cancel at any time by replying STOP to any message. After you send STOP, we will send one confirmation and then stop sending messages. To rejoin, reply START.

Privacy

No mobile information (including phone numbers and SMS opt-in) is sold or shared with third parties or affiliates for their marketing or promotional purposes. See our Privacy Policy for details.
